Terms & Conditions
THE FRISCO NEWS
1. GENERAL RULES AND DEFINITIONS
1.1 By accessing or making use of the thefrisconews.com website, The Frisco News mobile platform, related applications, or any features of these offerings—such as RSS feeds, APIs, software, and other downloads (collectively, the “Services”)—or by buying or using any form of membership (as defined below), you agree to adhere to and be legally bound by every provision of these Terms of Service. These Terms of Service constitute an agreement between you and The Frisco News Corporation (“FN,” “Frisco News,” “The Frisco News,” “us,” or “we”).
1.2 We reserve the right to modify, add, or remove segments of these Terms of Service at any time; such changes take effect immediately upon being posted. It is your responsibility to review these Terms of Service, and by continuing to use this site or any related Services, you indicate acceptance of any modifications.
1.3 IF YOU FIND ANY OF THESE TERMS OR ANY FUTURE REVISIONS UNACCEPTABLE, YOU MAY DISCONTINUE YOUR MEMBERSHIP BY CONTACTING CUSTOMER SERVICE AT thefrisconews@gmail.com. CANCELLATION REQUESTS WILL NOT BE PROCESSED VIA CHAT (unless the law mandates otherwise). If you carry on using the Services now or after any notice of changes has been posted, it signifies your acceptance of these rules or any subsequent modifications.
1.4 We may at any time alter, suspend, or end any feature of the Services, which may include removing the availability of certain functionalities, databases, or content. We may likewise establish limitations on specific features or Services, or limit your access to parts or all of the Services, without prior notice or liability.
2. CONTENT OF THE SERVICES / MEMBERSHIPS
2.1 The material available through the Services, including on our sites (the “Content”), is meant for your personal and noncommercial use. All published materials (including, but not limited to, news stories, images, photos, audio clips, and videos) are protected by copyright and owned or managed by The Frisco News or the credited provider. You must follow all additional copyright notices, details, or restrictions contained in any Content accessed via the Services. Personal, noncommercial use expressly excludes the following actions unless you have prior written approval from The Frisco News:
(1) using Content for creating or training software, such as machine learning or AI systems;
(2) providing archived or cached datasets featuring the Content to anyone else;
(3) scraping data from the Services for commercial purposes (e.g., using our information for real estate-related promotional material).
2.2 Both the Services and the Content are protected by U.S. and international copyright laws. You may not edit, publish, transmit, sell, reproduce (except as indicated in Section 2.3 of these Terms), generate derivative works from, distribute, perform, display, or use in any manner any Content or Services (including software) in whole or in part.
2.3 You are permitted to download or copy Content and other downloadable materials shown through the Services solely for personal use, provided that you uphold all copyright and other notices included with them. Any copying or storing of Content beyond personal use is strictly disallowed unless authorized in writing by The Frisco News Rights and Permissions Department or the copyright owner mentioned in the Content’s copyright notice.
2.4 Ownership or licensing of the Content belongs to FN. Certain items are supplied by agencies (such as the Associated Press or Reuters). These agencies assume no liability for any delays, inaccuracies, errors, or omissions in the Content, or any issues with its transmission, and will not be liable for any subsequent damages.
2.5 Memberships
This Section 2.5 covers the terms for accessing Content or Services via print memberships to The Frisco News magazine (“Print Membership”) or subscriptions to The Frisco News e-paper, The Frisco News apps, and thefrisconews.com (“Digital Membership”). “Digital-only membership” means a membership strictly for digital access; “digital products” refer to paid digital offerings from The Frisco News, including Digital Memberships. “Billing period” indicates the interval from the beginning of your membership to its designated end date.
-
(a) You are not obliged to make any purchase to view thefrisconews.com or The Frisco News apps. However, without a Digital Membership, your access to Content and Services will be limited. FN may adjust the structure, type, or availability of Digital Memberships whenever necessary.
-
(b) Only one individual may utilize an account tied to a purchased Digital Membership or Print + Digital Membership.
2.6 Pricing and Payment Terms for Memberships
(a) When you obtain a Digital Membership or a Print Membership (referred to both individually and collectively as a “membership”), the price you will pay is revealed during the order process. By completing your order, you affirm you will pay the stated amount plus any applicable taxes and abide by the stated billing frequency. Discounts for new members apply at the time of ordering and cannot be applied retroactively. Introductory discounts are not accessible to current members or those who were members within the previous 90 days. All prices are in U.S. Dollars. The Frisco News may adjust fees and prices at any point; you will be notified if your membership rate changes from the initial amount, and you’ll have the option to cancel or adjust your membership. If you neither cancel nor alter your membership, you will be charged the new amount for your next billing period. Unless otherwise specified, your membership will automatically renew if you do not cancel before the current billing cycle ends. Taxes may vary, and we may not inform you in advance of any adjustments to them. If an advertised price is found to be incorrect, we are under no obligation to provide you the membership at that price. Instead, we will notify you and offer a cancellation with a refund if payment was already made. Should you suspect someone is using your account without authorization or notice a charge for a product or service you did not request or have access to, contact thefrisconews@gmail.com.
(b) You can find details about your membership, including billing periods and payment methods, in the Member Center at www.thefrisconews.com.
(c) The Frisco News processes all membership orders promptly but retains the right to decline any order at will. If your initial payment authorization is canceled later, your membership or product access might be terminated. Please contact us if you think your membership was canceled incorrectly.
(d) By renewing or paying for your membership—whether by check, credit card, or any other accepted method—you confirm your agreement with the then-current Terms of Service. Unless otherwise noted, all charges are final and nonrefundable. To change a payment method, visit the Member Center.
(e) Payment for Digital Membership. We accept major credit cards and PayPal. We will charge or debit your provided payment method at the beginning of your digital-only membership or, if you have one, following your free trial. Billing will continue based on the agreed billing interval. In addition, you could incur other charges like data or telecom fees, which are your responsibility to pay. Applicable digital taxes may also apply.
(f) Payment for Print or Print + Digital Membership. We accept major credit cards, electronic funds transfers (EFT), and checks. Service dates may change without prior notice. Service adjustments (e.g., a shift in delivery frequency, service interruptions) can affect your pay-through date. A temporary service suspension does not push back your pay-through date.
(g) Non-Membership Digital Purchases. If you buy a standalone product (separate from any membership) like merchandise or an individual article, we will charge or debit your payment method immediately.
(h) Automatic Renewals. Unless you explicitly instruct us otherwise, any purchased membership automatically renews. Upon each renewal, we will use the payment method on file for your account. You can switch payment methods any time in the Member Center. Where the law requires, you will be informed in advance about impending renewals. Refer to our Cancellation and Refund Policy below for cancellation details.
(i) Unpaid Charges. If your payment method becomes invalid (e.g., your credit card expires), your membership or product might be discontinued instead of renewed automatically. If your membership is set to auto-renew, you authorize us—at our discretion—to continue providing digital or print products and to bill you at the same rate, even after your membership period ends, until you cancel. You will be responsible for amounts due and any collection costs incurred, including legal fees and related expenses.
(j) Promotions. Occasionally, we may run promotional offers with their own terms stated at the time of the offer. Promotions differ, cannot be stacked, and may require you to provide payment information when you sign up. Once the promotion ends, you will automatically continue with the corresponding membership or be charged the regular rate that was disclosed at signup. You will not receive a reminder that the promotion is about to end, so you must cancel in advance if you do not wish to continue.
(k) Purchases of Memberships via Third Parties. If you bought a product or membership through a third party, the above pricing and payment details may not apply. We are not liable for disputes related to purchases made via external parties. Please contact them directly for assistance.
(l) Additional Products or Services. At our discretion—and free of additional charge—we may send you a printed edition or related product on a day you do not subscribe to print, or we may offer you new or additional products to purchase because you hold a print or digital membership.
(m) Cancellation and Refunds. You are free to cancel your membership at any point by contacting Customer Service. Cancellations cannot be processed via chat (unless legally required). Residents of CA, VT, VA, and OR may email thefrisconews@gmail.com to cancel. When you cancel, only future charges are stopped. You retain your current membership benefits and access until the end of your existing billing term. You can inform us anytime of your decision to cancel, but the cancellation will only be effective at the end of your current billing cycle. There will be no refunds or credits for partial billing cycles. We may, at our discretion, grant refunds or credits or allow a relocating print subscriber to convert to a digital membership, but this does not obligate us to do so again in the future. We may change our print or digital memberships at any point. If we cut or drop charges for features or access that you currently pay for under different terms, you will not receive compensation.
In the event the print edition’s publication days are reduced or printing ceases altogether—whether temporarily or indefinitely—WE MAY CHANGE YOUR PRINT MEMBERSHIP TO A DIGITAL-ONLY OR A SUNDAY+DIGITAL MEMBERSHIP. We will inform you of the new terms if such modifications happen.
We reserve the right to make changes to digital products at our discretion. We also reserve the right to suspend or terminate any membership or product access for any reason, without notice or further obligation. In such scenarios, refunds are not provided. If our digital products are temporarily unavailable, no refund or adjustment will be made.
For non-membership purchases, we may, at our sole discretion, decide to provide refunds or credits. Our decision in one case does not oblige similar refunds or credits in the future.
(n) Communications from Us. By purchasing a membership and/or checking the relevant box when creating an account, you agree to accept electronic notices, disclosures, policies, agreements, receipts, confirmations, transaction details, and account information (together, “Electronic Communications”) from us. These Electronic Communications will be sent to the primary email address on record for your membership. You accept that these Electronic Communications meet any requirements that they be provided “in writing.” They will be considered received within 24 hours after we send them, unless we get a delivery failure notification. It is your responsibility to ensure your email address on file is accurate and current.
3. USER-GENERATED CONTENT: SUBMISSIONS (COMMENTS, PHOTOS, CONTEST ENTRIES, ETC.)
3.1 You agree not to upload or distribute any libelous, defamatory, obscene, pornographic, abusive, or otherwise unlawful material via the Services. You further consent to be polite in all user-generated content. You agree not to threaten or verbally abuse other users (“Members”), engage in libel, or disrupt ongoing discussions by posting repetitive or irrelevant messages (“spam”).
All submitted content or user interactions must use respectful language. Our community thrives on making Members feel safe and welcome. You may not engage in language that discriminates or demeans others based on race, religion, nationality, gender, sexual orientation, age, region, or disability. Hate speech of any sort is forbidden and will result in immediate and indefinite suspension of your access to any or all parts of the Services.
Debate is encouraged, but personal attacks are not. Heated discussions are welcome, yet personal attacks violate these Terms of Service and may result in immediate and indefinite suspension. We may also report potentially threatening or inciteful comments to the authorities, along with your information, if warranted by law.
You may not impersonate other users or FN staff members, including by adopting a username similar to someone else’s. You must disclose any conflicts of interest with your Submissions.
3.2 You must use the Services solely for non-commercial reasons. Without specific authorization from FN, you may not share or publish any content containing advertisements or solicitations for funds, goods, or services.
3.3 You understand that any material you submit to the Services (including, but not limited to, comments, forum posts, reviews, text, photos, videos, audio, code, and software applications) (each a “Submission”) can be reviewed, modified, or removed by FN at its discretion. You waive any rights to object to modifications or alterations that you might not find agreeable. You also acknowledge that Submissions to the Services may be featured in FN’s RSS feeds, APIs, and other distribution methods, both now and in the future.
3.4 By posting a Submission, you grant FN an ongoing, nonexclusive, worldwide, royalty-free license—transferable to our sub-licensees—to use, copy, send, excerpt, publish, distribute, publicly show, publicly perform, develop derivative works from, host, index, store, label, adjust (including for streaming, downloading, broadcast, mobile, digital, thumbnail, scanning, or similar technologies), or otherwise adapt the Submission in any medium currently known or invented in the future, both within the Services or on any other platforms owned by FN.
3.5 You assume sole responsibility for the content you submit. While FN does not and cannot monitor every Submission, and does not accept responsibility for user content, it maintains the right to remove, relocate, or edit Submissions that violate copyright or trademark laws, are defamatory or obscene, are abusive, or for any other reason it sees fit.
3.6 By posting a Submission, you grant FN permission to display and publish it within the Services and for relevant promotions, both online and offline.
3.7 By posting a Submission, you also acknowledge that if the Submission threatens violence, potentially incites violent or illegal acts, or may be unlawful, we may respond by conducting investigations, alerting the authorities, and cooperating with any investigations, including disclosing your identity to law enforcement agencies, as deemed appropriate and/or legally necessary.
3.8 No compensation or payment will be provided to you (or any third party) relating to Submissions, regardless of how they are used.
4. ACCESS AND AVAILABILITY OF SERVICES AND LINKS
4.1 The Services may include links to external websites, resources, or advertisers. We are not responsible for the availability or content of external links. Direct concerns about any external site to its respective administrator or webmaster.
4.2 You must not access or use the Services (or try to do so) in ways that might harm us, others, or that violate any law or any legal, proprietary, or intellectual property rights. You also agree to refrain from circumventing, reverse engineering, decompiling, or tampering with the Services or any of their content. Specifically, you must not do the following without prior, written consent:
-
Access or attempt to access any part of the Services, data, or Content that you are not authorized to view, or for which FN has revoked access.
-
Use automated or manual tools (robots, spiders, scripts, or similar services/software) to extract (“scrape”) data or information from the Services.
-
Utilize the Content for developing any software, including training artificial intelligence or machine learning models.
-
Employ any methods to circumvent security features or usage limits placed on the Services.
-
Cache or archive the Content (unless it is for a public search engine building search indexes).
-
Take actions that place an excessive or unreasonable load on our systems.
-
Engage in any activity that could impair, damage, or alter the normal operation or appearance of the Services, including how ads are displayed.
4.3 Any prohibited use of the Services may lead to civil, criminal, or administrative penalties for the violating user and anyone who assists that user.
5. REPRESENTATIONS AND WARRANTIES
5.1 You confirm, warrant, and covenant the following:
(a) You will not submit any Submission or material through your account that (i) infringes or violates the rights of a third party—including copyright, trademark, privacy, or personal or proprietary rights—or (ii) is unlawful or defamatory.
(b) You are at least thirteen (13) years of age.
You agree to defend, indemnify, and hold FN (along with its officers, directors, owners, agents, affiliates, licensors, and licensees, collectively the “Indemnified Parties”) harmless from any claims, costs, and fees (including reasonable attorneys’ fees) that arise from your breach of these Terms of Service or from any Submission. You shall provide all reasonable assistance necessary for the defense against such claims. FN may, at its expense, assume exclusive defense and control of any matter otherwise subject to indemnification by you.
5.2 FN does not represent or endorse the reliability or correctness of any piece of advice, opinion, statement, or other information displayed or disseminated by users, information providers, or other entities within the Services. You recognize and agree that any dependence on such statements is at your own risk. THE SERVICES, ALL CONTENT, AND ANY DOWNLOADABLE SOFTWARE ARE PROVIDED “AS IS,” WITHOUT ANY WARRANTIES (EXPRESS OR IMPLIED), INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE. YOU ACCEPT THAT YOUR USE OF THE SERVICES IS SOLELY AT YOUR OWN RISK.
6. REGISTRATION AND SECURITY
6.1 When creating an account, you must choose a password and supply an email address. You must also furnish accurate and up-to-date registration details.
-
(a) You are forbidden from (i) using login credentials belonging to another individual with the aim of impersonating them; (ii) using login credentials without permission; or (iii) using a username that FN deems offensive or inappropriate. Violations can result in immediate account termination.
-
(b) You are responsible for protecting the secrecy of your password.
6.2 You must alert thefrisconews@gmail.com of any suspected or confirmed unauthorized access to your account, including the loss, theft, or unauthorized disclosure of your password or financial details.
6.3 You must be at least thirteen (13) years old to use or subscribe to any portion of the Services.
6.4 You bear full responsibility for all actions taken under your FN account, including any activity by a third party whom you have authorized to use your credentials. Any fraudulent, illegal, or abusive activity may result in the immediate termination of your account, and FN may refer you to law enforcement. Where appropriate, FN’s policy is to terminate the accounts of repeated infringers of intellectual property rights.
7. FEES AND PAYMENTS
7.1 We may, at our discretion, start charging fees for some or all parts of the Services. If we decide to charge you for something that was previously free, you will be informed in advance and can choose to continue or discontinue your use. If you do continue, you agree to pay the applicable charges for that billing period. This includes fees associated with any digital products or services offered through the Services by FN or third parties, and you are responsible for all related taxes. The conditions in this Section 7.1 are in addition to the membership payment terms detailed in Section 2.6 above.
8. COMMUNICATIONS BETWEEN THE FRISCO NEWS AND USERS
8.1 If you indicate during registration (or afterwards) that you wish to receive information about products or services, we may send you promotional emails. You can opt out of these communications at any time by following unsubscribe links or updating your account settings.
8.2 FN may send you messages electronically to inform you of changes or additions to the Services.
8.3 FN reserves the right to reveal information regarding your usage and demographics, provided it does not personally identify you. Advertisers or partners on our sites may only collect and share your personal data with your explicit approval. For more details, please review our Privacy Policy.
8.4 We may reach out via email to ask for your participation in user surveys or to get feedback on existing or future Services or products. The information gathered helps us improve the Services. Any details we gather from such surveys will not be shared with third parties, except in a summarized form.
9. SOFTWARE LICENSES
9.1 You hold no ownership interest in any proprietary software or its related documentation (including updates) provided in order to use the Services (“Software”), which remain the exclusive property of FN and/or its licensors. You may not transfer, assign, or sublicense the licenses granted. You are permitted to make only one archival copy. You may not copy, distribute, alter, decompile, or create derivative works from the Software.
10. TERMINATION, CANCELLATION & REFUNDS
10.1 You can cancel your membership any time via your account portal. Cancellations cannot be processed via chat (unless state law specifies otherwise). Residents of CA, VT, VA, and OR may email thefrisconews@gmail.com to cancel. More details on membership cancellation are in Section 2.6(m).
10.2 FN can terminate or suspend your access, partially or fully, at its sole discretion for any reason, including breach or transfer of these Terms of Service to another party.
